these terms of service ("agreement") constitute a legally binding agreement between you ("user" or "you") and cryptic bot ("service provider," "we," "us," or "our"). by adding or using cryptic bot on any discord server or platform, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions herein. if you do not agree to these terms, you may not use the service.
subject to your compliance with these terms, we grant you a limited, revocable, non-exclusive, and non-transferable license to use cryptic bot in accordance with its intended functionality. this license is personal to you and may not be assigned, transferred, or sublicensed to any third party without our prior written consent. any use of the service beyond the scope of this license is strictly prohibited.
you agree that you shall not, and shall not permit any third party to, directly or indirectly:
the collection, processing, storage, and use of user data is governed by our privacy policy, which is incorporated herein by reference. by using the service, you explicitly consent to the data practices described in our privacy policy. you acknowledge that you have reviewed and accepted the privacy policy in its entirety. for full details regarding data handling, retention, and your rights, please consult our privacy policy document.
cryptic bot is provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or title. we do not warrant that the service will be uninterrupted, error-free, secure, or free from harmful code.
to the fullest extent permitted by applicable law, in no event shall we be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if advised of the possibility of such damages. our total liability to you shall not exceed the amount of fifty new zealand dollars ($50 nzd).
we reserve the right, at our sole discretion and without prior notice, to suspend, disable, or terminate your access to cryptic bot if we determine, in our reasonable judgment, that you have violated these terms, engaged in harmful or unlawful conduct, or pose a risk to the service or its users. we will make reasonable efforts to provide notice of such termination where practicable.
we reserve the right to modify, update, enhance, or discontinue cryptic bot or any component thereof at any time, with or without notice. we further reserve the right to amend these terms of service at any time. material changes will be communicated through our official discord server. continued use of the service following such modifications constitutes your acceptance of the amended terms.
cryptic bot is not affiliated with, endorsed by, sponsored by, or associated with discord, inc. discord is a registered trademark of discord, inc. all references to discord in this document are used for identification purposes only. all intellectual property rights in the service remain the exclusive property of the service provider.
these terms shall be governed by and construed in accordance with the laws of new zealand, without regard to its conflict of law provisions. you irrevocably submit to the exclusive jurisdiction of the courts of new zealand in respect to any disputes arising from these terms or your use of the service.
prior to initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiation. if negotiation fails, either party may seek resolution through the appropriate courts of new zealand.
if any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. the remaining provisions shall continue in full force and effect.
